' Nicholls.— Claim, 8d 9d, for newspapers supplied.; Defendant disputed his liability, on the ground that in January last he had given written notice to the proprietors of The Mail to discontinue the paper at the end of three months from that date, In answer to questions by plaintiff, defendant admitted that the papers had been thrown over his fence. Some of them might have been taken in. He migkt have read them, but did not consider that was relevant. If he gave a baker instructions

to cease supplying him with bread and afterwards took in the bread and ate it, it " would depend upon circumstances" whether he would pay for it. Alfred Mitchell deposed to having left the papers at defendant's. He used to throw them over the fence and call out. A girl used te come out and take them in. Plaintiff contended that the acceptance of delivery by defendant was a completion of the contract. The point had been decided over and over again.
