Saturday, Junk 12. ! . ■ ' ' A meeting of this. Board was held on the above date, at their offices, Duvauchelle's Bay. Present —Messrs Chappell (in-the chair), Shadbolt, M'Donald, Williams and Piper. MINUTES. The minutes of the last meeting, were read and coulirmed.

They were aware it was badly wanted. It was decided that Mr Curry should undertake the Avork himself, and should look to the Board for remuneration for the same when they were in funds. OLD DUVAUCHELLB's BAY ROAD. Mr Libeau waited upon the Board to know what had been done re closing the Old Duvauchelle's Bay Road. * The Chairman read a letter from tbe Colonial Secretary, Wellington, to the effect that the matter had been referred to the Law Officers'of tbe Crown, and it had been decided that tbe regulations of the Public Works Act had not been complied with, and that consequently the whole; of the steps would have to be recommenced and gone through. Mr Libeau stated that he had, in accord--ance with the Act, deposited tbe' required' money, and had lain out of it for three years ; he thought it rather bard. Mr M'Donald considered the-Board were in duty bound to close, the road legally after having received Mr Libeau's moneys Mr Williams asked what was the error which had been made. He Was informed that the mistake was in the dates of advertising the various notices and the calling of the public meeting ; that the Act enjoined certain' periods for publicly notifying the same, which had not been complied with.

Mr Williams said he thought there was something wrong somewhere. That he re-' membered hearing some three months back from the Government that there was only one mistake, and that mistake had been rectified. He could not understand why , that was not sufficient. : He was informed that on tho Board rectifying the' mistakes by forwarding the gazette notice, the Gpvomment had found out that the dates did not agree with the Act. Mr Libeau said he would rather have the road closed than have bis deposit returned. The Board acknowledged that error had been made, but that it being the first time they had had to ta_e such proceedings perhaps the mistake was'excusable. Mr Libeau was informed that.the' matter would be attended to. MOUNT BOSSU ROAD. ' ' Mr McKay waited on the Board to know when the new road through Rhodes' Flat would be likely to be opened, as at the present time the public were making a road through his land, and had been doing so for the last ten years. He would be willing to allow this to continue for a short time, if the Board wonld mention a date when the new road could be opened ; if the Board could not do so he thought it would be best for him to close up his land and stop the public.making a thoroughfare through it. ■' \ ; Mr McKay was informed that the Board were doing all they could to get the steps necessitated by the Act carried out, and they could do nomore. Wood, Christchurch, acknowledgeingreceipt of a summons from the Board for rates, and stating that he was not tbe owner, and that he had informed the Clerk so when lie had been advised that his name was on the roll. He had stated the same and had not been written to first and asking that Mr Montgomery's name (the rightful owner) might be put on the roll and his own taken off. Reply was sent that that stop could not bo taken for tho present year. From the Secretary to the Domain Board, asking the Board to make a slight improvement to the-approach at the last entrance to the Domain,* The Board regretted funds wore not available. From H. C. Buchanan, asking whether certain rates for land at Wainni had been paid. From the Colonial Secretary, Wellington, stating that in tho matter of- the French Farm Bay road that the newspapers stated to have been forwarded by the Board had not been received, that they were not positively necessary, but that a statutory declaration by the Chairman of the Board made; out in terms of section 28, " Public Work's Act, 1870, Amendment Act, 1878," will be needed. Resolved that it be sent. From the Clerk, Little River Road Board, stating that that Board had appointed Mr A. McPhail, of Island Bay, to arbitrate on their behalf in the matter of the Mount Bossu ridge road, and asked the Boaul to appoint an arbitrator to represent them. Proposed by Mr Williams, seconded by Mr McDonald—"That Mr Wilkins be appointed arbitrator to act on behalf of this Board, in the matter of the Mount Bossu -road." That Mr McPhail be informed the same, and that Mr Wilkins

put himself in communication with Mr McPhail, with a view of appointing the date and tbat the necessary deed be prepared and signed. From Francis Narby, Long Bay, stating that tbe road now formed would not get him out of hia difficulty in getting out of Long Bay,, nnd proposing that if tko Board would call tenders ior thirty chains more he would hand over a cheque for the amount vrhen '• requested, provided the Board agreed' tQ re-imburse\the amount ' whet* in funds. V ,' The offekvvas considered a _avorabl.e one, and it was proposed by Mr Shadbolt that the offer be accepted, and tbe work be put in Hand at once ; that Mr Barwick inspect the' place and be authorised to call for tenders for tha same. -' Seconded by Mr Shadbolt and carried. From James Brown, German Bay, stating that he bad written to Mr Roberts, objecting to the survey. made to show encroachment 'made by the road on.bis land, enclosing Mr Roberts' reply, likewise a bill for expenses incurred in the same. Resolved that be be infoimed that the matter was taken out of the Beard's hands and placed in those; of the old Provincial Government.' ' ■' ' ' From P. From tbe Pigeon Bay Road Board, re Haines' road in .the process, of construction, asking the Board to inform them jhow much of the work ; s waa done, what passed the work, what money had been paid on it, and any othermatters of importance in connection with the 'same.- • "'•' ! \ ' : -" : '" '' '" Mr Dusbury's report on the same was read, giving'a favorable report, showing £150 had been paid on the same. = MrM'Donald proposed that the Chairman and the Chairman of the Pigeon Bay Road Board be requested to meet together with Mr Duxbury, and inspect tbe work, and furnish the Board with a report. Seconded by Mr Shadbolt and carried; From H. E. Alport, Christchurch, trustee of Wm. Kenny's estate, stating that according to the statement of liabilities and assets in bis estate the sum of £49 appeared as being duo by the Board, and requesting that a cheque for the amount might be forwarded. From the Clerk to the Little River Road Board' re application made By Messrs Wood, Allen, and othersremaking certain alterations in the boundaries between tbe two Boards. ...... Mr Williams proposed, and, Mr Piper seconded—" That the Little River Road Board be written to re alteration of boundaries, stating that this Board fails to see any advantage to this district in the proposed alteration, nor do they see that the matter of the watershed can be satisfactorily settled, as any exchange must leave the Wainui district partly in that of the Little River watershed., After some i discussion,' the motion was carried, Mr M'Donald alone dissenting. From Mr M'Niel, claiming £40 for encroachment of theFrerich Farm Main road on bis land. ; ■ r Tbe 30th section of > the Public Works Act having been read, it was proponed by Mr M'Donald—"That Mr M'Niel be informed that this Board do not agree to his claim for compensation on the Wainui road, that the notice be given in accordance with tbe Public Works, Act. and that the .Chairman and Mr Williams, be.authorised to take any necessary action pending the next meeting of the Board." Seconded by Mr Shadbolt arid carried. , vogan's road. , . Mr Vogan waited upon the Btiard re forming the road to hia property from Pawson' Valley. It was resolved that Mr Barwick ascertain the cost of the required work, and .inform the Board of it at the next meeting. .! ' ONUKU ROAD. ! A petition was read from Messrs Haylock, Brown, Glytian,.and others, asking the Board to erect a bridge over the creek at Onuku. ■ r It was resolved that the petitioners be informed that the Board cannot undertake the work for want of funds. GERMAN BAY. i From Mr J. Hammond, asking for a road to be made to his pioperty situate in German Bay, as at present ho had to pay for a right-of-way to Mr Dawber. It was resolved that tbe Clerk visit and report on the same. WAINUI ROAD. j- From Mr A. C. Knight, reminding the Board that there are several heaps of hroken metal stacked On tbe road near his ..house, and trusting the Board would have the same spread in the direction of French i Farm on those portions of the road {most requiring It, and asking if the Board aie taking any steps towards opening tha now ' road through Rhodes Flat, as since the old road has been closed it was necessary that the new one should be made available for traffic. .

From same, pointing out the dangerous J state of the crossing at M'Kay's creek whore Mr M'Phaii'Svaa supposed to put a bridge, and trusting the work would be pushed forward at once to prevent an accident ; should such a circumstance happen it would be very serious to the ratepayers. Proposed by Mr Williams, seconded by Mr M'Donald, and carried —" That Mr M'Phail be requested to go on with the Mount Bossu road bridge forthwith to prevent the Board carrying out the forfeiting clause of the specification." Tenders. • ; Tenders were'ordered to be called .for the repair of the bridges at Duvauchelle's and the Head of the Bay creeks. The following tenders were opened :— FLEA BAY ROAD. W. Jones, one month, £28 5s Gd. P. Shadbolt, six weeks, £23 4s. C. Schubert, two months, £26 16s6d. A. F. Hawthorne, three months, £17 Bs. Funnel and Curragh, three months, £43 10s. G. Raven, £24 10s.
