Civil Cases.

J. F. Roberts v. Trigg.—Claim, £ig. Judgment exparte for amount claimed aifd costs. ,

Leprou v. Libeau.—Claim, £7 12s, for machinery supplied. £4 10s was paid into Court. In this case defendant alleged that lie had been charged an exorbitant price, but by his own confession when put on oath, it was proved that plaintiff had told him what the coat of the job would be prior to his taking over the machine. His Worship gave judgment for the full amount and costs.

E. C. Latter, Deputy Land Tax Commissioner, v. J. Bates.—Claim, £4 12s Bd, for rates and Court expenses. Mr Nalder appeared on plaintiff's behalf. In this cane the matter in dispute was whether the Court was entitled to claim the extra mileage rate, 16s, for the service of a summons at Wainui, when in reality the summons had Loen served on Mr Bates in Akaroa. Defendant further alleged that he had tendered the amount (less the 16a in question) to the Clerk of the Court. The Clerk did not admit the tender, and also stated that what took place v/as after office hours. His Worship decided that what defendant called an offer of the amount was not a 11 tender" in the legal sense. Prior to the summons being issued the plaintiff would

be obliged to pay the mileage. He therefore gave judgment for amount claimed with costs, and solicitor's fee, £1 Is. The Court then adjourned.
