AKAROA RESIDENT MAGISTRATE'S COURT.
Tuesday, March 2,
(Before H. H. Fenton and G. H. Saxton, Esqs., J's.P., and his Worship the Mayor.)
FAILING TO PROVIDE
Edmond Leprou was charged with neglecting to provide for his wife and family.
Defendant denied having failed to provide for his family. It appeared, however, that he had been guilty of violent conduct on more than one occasion. He was willing to consent to a seperation and an order for maintenance.
The Bench made an order for the payment of 30s a week, to be reduced to 20s if defendant provided a house for his family. In default, one month's imprisonment.
Civil Cases. Billens v. Brocher.—Claim Judgment by default fcr amount claimed with costs.
(His Worship the Mayor here left the Bench.)
Borough of Akaroa v. D. Watkins.— This was a claim for £2 12s. being the amount of rates due on the premises lately occupied by Mr J. D. Davis, in Church street. Dr Watkins was sued as owner of the property.
For the defence, Mr S. Watkins, who appeared for his father, contended—l. That no notice had ever been delivered. 2. That Dr Watkins was not tho owner. The ground was let on lease for twentyone years, and until the expiration of that period he had no control whatever over the property as long as the conditions of the lease were fulfilled.
On the latter point the Bench decided against the defendant. With regard to
the notice, there appeared to be considerable doubt. A certain amount of laxity had been shown as regarded tho notice. Judgment would be given for the plaintiff, but without costs.
Arming v. Lemounier.—Judgment summons. Defendant was ordered to pay 5s a week. In default, a month's imprison-
ment
Tho Court then adjourned.
Thursday, March 4,
(Before Justin Aylmer, Esq., R.M.)
DRUNKENNESS. W. Black, alias W. B. M'Ewen, was charged with being drunk and disorderly. W. Thomas was also brought up on a similar charge.
In both cases defendants were dismissed with a caution.
