AKAROA RESIDENT MAGISTRATE'S COURT.
Friday, Nov. 15. (Before W. B. Tosswill, Esq., J.P.) FURIOUS RIDING.
C. Haylock was charged, on the information of A. Nicholls, with this offence on 6th November, in Akarca.
Mr Nalder appeared for defendant Fined 20s and costs.
(His Worship the Mayor here took his seat on the Bench.) Civil Case, o'reilly v. little.
Claim, £3. This case had been adjourned from a previous occasion for the production of further evidence. Mr Nalder appeared for the plaintiff. The additional evidence adduced was that of Michael O'Sullivan, who had been summoned from the Ashburton. His evidence entirely corroborated that of the plaintiff as to defendant having engaged a box for the season.
For the defence, A. Phillips and J. Sunckell were called, but their evidence did not throw any light on the question of an agreement having been made or not. Mr Sunckell' deposed that defendant had made use of his stable during the season in question, paying for it at per night. At the conclusion of the case, the Court adjourned for a quarter of an hour. On resuming, Mr Tosswill delivered judgment. He said that he and his brother justice were not of the same opinion on the case, but, as senior magistrate, his decision would be that of the Bench. He saw no reason to disbelieve the v evidence of Sullivan, an independent witness, and it was also highly improbable that plaintiff would have boarded up the loose box unless he had let it. Judgment would be for the plaintiff for the amount claimed with costs.
