AKAROA AND WAINUI ROAD BOARD.
Saturday, Nov. 2.
A meeting of this Board was held in the office. Head of the Bay, on the above date, at 7 JSO p.m. The meeting was put off to this hour to allow of Mr Lattor's meeting taking place in Akaroa.. Present —Messrs Duxbury (in the chair), Curry, Williams, Shadbolt, and McDonald.
The minutes of the last meeting were read and confirmed.
Several tradesmen having presented orders on the Board given by workmen and contractors, tho Board again wished it to be distinctly understood that no order whatever would be recognized, and that workmen giving orders would not be employed in future.
CORRESPONDENCE,
A return of assets and liabilities of the late Provincial District at 31st December last was received from the General Government.
Advice of the payment of £G0 9s 2d was received from the Treasury, being 10s per £ on the general rale collected to 31st March last, £120 18s 4d.
Letters were received from the Little River Koad Board in reference to a conference of members of the Boards on the 23rd nit., to arrange for forming the Lake Forsyth and Mount Bossu road so as to take advantage of the special grant of £900 for this purpose.
The Chairman reported that the meeting was postponed on the date mentioned owing to the absence of the Chairman of the Little River Board in Christchurch, but that a meeting had since been held, at which all questions in dispute between the two Boards had been arranged (a report of which appeared in our last issue).
A copy of a letter from Mr J. Ollivier to Mr A. C. Knight re his claims for compensation for road diversion was read, also the Chairman's reply. It was understood that Mr A. C. Knight had preferred 'no claim while Mr (Jllivier held his sittings in Akaroa on the subject of late Provincial
claims.
The Rev. J. W. Stack stated that he had sent the two Maori claims of £20 and £10 to the Resident Magistrate, Akaroa, for settlement.
The Clerk was directed to see that a proper discharge was given for the money.
Mr H. Piper wrote regarding his road diversion question, and also Mr Nalder, on the same subject, and asking further details, so as to enable him to convey to the Queen.
A telegram was received from the Government through Mr J. Aylrner, enquiring what price the Board would take for the stable on sec. 83, in Akaroa. The Board resolved to reply that they would take £70 for the stable, or £150 for all buildings on the section. If the Government does not accept them at this value, the Board would require tho six months notice as originally agreed upon by the Provincial Council to remove them.
In regard to the deed for the road through the Cemetery, Duvauchelle's Bay, the Clerk was directed to instruct the solicitor to have it prepared direct from original seller to the Board, without passing through the Cemetery Trustees. Mr T. S. Johnson, Robinson's Bay, asking for a refund of £5 paid to the Board for posts and rails on the old French road, which he had been unable to get by a decision of the R. M. Court. It was agreed to refund the money. Mr Eugene Lelievre complained that the fence along his property, Long Bay road, was still in the wrong place, in parts to the extent of 20 feet, and that nothing had as yet been done to make it sheep proof in terms of a previous resolution of the the Board.
The Clerk was directed to have the necessary earth put along the fence as previously directed, and inform Mr Lelievre that the Board's Engineer was now satisfied with the line of fencing.
Mr T. S. Duncan, Mr Breitmeyer's solicitor, requested to know what steps the Board intended to take re the old part of the road at the Horse-shoe-bend, before preparing the conveyance Breitmeyer to to the Queen. The Board resolved to pay Mr Breitmeyer for what land was required for the new road, but declined to part with the old road, and the Clerk was instructed to forward a copy of the original agreement to Mr Duncan. ■.
Mr George Armstrong wrote, refusing to act a.s arbitrator on behalf of the Board in the Mount Bossu compensation case to Mr McKay. Mr Thomson, solicitor, Ghristchurch, wrote, stating that a draft of the deed of conveyance of the Okain's Road along Mr Martindale's property was now ready, and that if it was correct, the land would be conveyed to the Queen. The Secretary of Public Works Wrote, returning the plan of tho old rorid which had been stopped by tho resolutions of the Board anil County Council in Duvauchelle'a Bay, and requiring a large number of further "particulars in regard io the reasons, &c, for stopping the road in question, as he had been advised by the Jaw officers of the Crown that a variety of other data weurc necessary before the Govemer'fci sanction could be asked to sell the road.
Tho Clerk was directed to supply the required information as far as I'ay in his power. The Board at the same time expressed a strong opinion that they would think twice before closing and selling any more roads, the legal troubles in the way being almost endless.
Mr H. Piper had written, requesting that the Board's Engineer, Mr Fenton, bo
requested to attend Mr Ollivier's sitting re land claims, as he was the person who knew more of the matter than any one else.
The Chairman explained that tli& matter had been attended to, and Mr Fenton had been present to give what information he was possessed of in regard to the various claims, not only in their district, but in
others.
The Engineer forwarded a tracing of the Mouiit Bossu road diversion through Mr Rhodes' property at Wainui, and the Clerk was directed to forward the same to Mr Rhodes.
Messrs Everalland Gunning , , contractors, wrote, offering to put culverts in the old Pigeon Bay road.
The Clerk explained that the original contract did not contain a provision for culverts. It was pointed out that the water channels on this road were not deep enough. The Clerk was instructed to visit and report on the matter, and call tenders for the culverts if required.
Mr J. F. Roberts wrote asking what steps the Board proposed to take in reference to the Le Bon's Bay road in German Bay Hat.
Mr Williams reported that the Committee, appointed at a previous meeting, had visited this road and had drawn up a report on the'subject, but as it was desirable that the Committee should be unanimous on the matter, and as there were some clauses in the report to which one of the members would not agree, he asked that the production , of the report be delayed until another meeting of the Board. Leave granted.
Mr E. Chappell requested the Board to widen the -new Long Bay road especially at Mie Rocky Point.
The Board thought the request came very quickly on the track of the completion of the road in question, but instructed Mr Banviek to visit and report *t his leisure.
Mr H. L. Aylmer, on behalf of himself and other settlers in the neighborhood, asked the Board to finish the Unr.ku road between Vangioni's and Kenny's contract, so as to allow the road to run continuously from end to end.
It was resolved to do the work asked for subject to the report of the Engineer. Mr Hawthorne, Onuku road, requested the Board to form culverts across part of this road, and also make catch-water drains, at the same time offering to do the work for £5.
The Board resolved not to interfere in the matter.
A largo number of reports were received from the Engineer, on matters of detail connected with the works the Board have on hand. Amongst others one recommending that in the Long Bay contract (Kenny's), a deduction of £18 should be made for nonfulfilment of specification \\n regard to ends of culverts. Also a letter from Mr Kenny, stating that he had authorized Mr G-. W. Nalder to act for him and receive the balances due on the Long Bay and Okain's Bay roads,

Mr T. Martindale waited upon the Board in reference to a drain in the Okain's Bay road diversion from which he was suffering damage
The Clerk was directed to see that Mr Martindale did not suffer in the matter.
Mr W. Wright waited upon the Board in support of a lotterjfrom Mrs H. Wright, offering to sell a part of section 10501 for the Mount Bossu road, at £10 per acre.
Mr W. McKay also saw the Board in regard to his offer to let the Board have the neccessary land for this road. Mr McKay was informed that Mr G. Armstrong now having refused to act for them, Mr J. F. Roberts had been appointed arbiter, and that both cases would be taken at the same time.

Mr Williams thought the only course open to the Board was to accept the lowest tender, although Jsuch was not always advisable. If a mistake had been made, the deposit should at least be forfeited to meet future advertising. He would move that Curtis and Wright's tender be accepted. Carried.

In addition to the above, Mr W. Kenny's Okain's Bay contract was passed, subject to approval and chainage of the Engineer, on the motion of Mr Curry, seconded by Mr M'Donald.
The Clerk was directed to have all plans and specifications in connection with the road and bridge in Robinson's Bay Main road ready by next meeting of the Board, and submit them for approval.
ENGINEER,
Mr Shadbolt enquired what reply had been received from the Engineer in reference to his accepting the permanent appointment olfered by the Board; he thought the offer should bo either accepted or declined.
The Chairman replied that no letter on the subject had been received from Mr Fenton, but that the engineering work uf the Board was being carried on as satisfactorily and as rapidly as could be wished.
It was resolved to ask Mr Fenton to meet the Board on the subject at their nest sitting.
The Board then adjourned till Saturday, 9th inst., at 1 p.m., after sitting till considerably past midnight.
