AKAROA BOROUGH COUNCIL.
Wednesday, Sept. 4. The usual fortnightly meeting of this Council was held at their offices on the above date. Present—Crs Meech, Penlington, Annand, Sunckell, Cullen, and O'Reilly. In the absence of his Worship the Mayor, Cr Penlington, on the motion of Cr Sunckell, took the chair. The minutes of the previous meeting were read and confirmed. correspondence. The correspondence outwards was read, and approved of. Letters were received— From the Colonial Secretary, acknowledging receipt of by-laws. From Mr R M. Barry, stating that he had become security for Mr E. W. Morey's contract, in ignorance of the law on the subject, and asking the Council to relieve him of responsibility in the matter. From Mr W. Jones, offering to become security for Mr Morey's contract. From Mr J. Daly, in reference to the removal of his fence in Lavaud street. From Mr Westenra, Bank of New Zealand, complaining of a drain in Balguerie street, close to the bank. Cr O'Reilly suggested that the slaughterhouse by-laws should be printed along with the others. Cr Cullen moved that Mr Barry be relieved of the position of security for Mr Morey's contract for Farr's bridge. Cr Annand seconded the motion, which, after some discussion, was agreed to. Cr O'Reilly moved that Mr W. Jones be requested to sign the necessary bond for Farr's bridge contract. Seconded by Cr Sunckell, and carried. DRAIN AT BANK OF NEW ZEALAND. Cr Cullen moved that the application of Mr Westenra be considered favorably, and that the Works Committee be authorized to procure the necessary pipes, and fill in riie ditch from the back of the bank section to the footway. He had always been strongly of opinion that this drain should be filled in all the way up Balguerie street. Cr O'Reilly would rather see the matter held over until a fuller meeting of the Council. He did not, at the same time, see why the Council should do this work for the bank, and not for others. He would, therefore, move that Mr Westenra's letter be reserved till a fuller meeting of the Council. Cr Meech seconded Cr O'Reilly's amendment. The matter had often been before the Council, and he was of opinion that they should do the lot if they once started, but that would require more funds than they had at their disposal. Cr Cullen's motion, not being seconded, fell through, and that of Cr O'Reilly was carried. DALY'S FENCE. Cr O'Reilly wished to know if there was a resolution of the Council to the effect that Mr Daly was to shift his fence. Mr Daly had told him that he was about making alterations in his premises, but had not quite decided how, and it would be a pity to shift the fence until Mr Daly had matured his plans. Cr Meech explained that it was a resolution of the Works Committee that all encroachments on the streets be moved back to the proper line ; Mr Daly's was not specially mentioned. Cr Sunckell moved that the resolution of the Works Committee be adhered to, and that all fences be at least 6 feet off the kerb of footway. Seconded by Cr O'Reilly. Cr Meech moved as an amendment that, in consideration of the proposed alterations to Mr Daly's premises, the time for removing his fence be extended two months. Seconded by Cr Annand. The amendment was put and carried, Cr O'Reilly dissenting. PAYMENTS. The following accounts were presented for payment, viz. :— E. C. Latter, lamp-posts ... £2 17 6 J. D.Davis 0 14 6 J. Cr Meech wished to know if these ac" counts had been examined by the Finance Committee ; he thought this course should always be followed. The Chairman quite agreed with Cr Meech, and stated that in this case' the accounts had not been examined. Cr Sunckell moved that the above accounts, with the exception of Mr Latter's and that for lighting, stand over till next meeting of the Council. • Seconded by Cr Annarid and carried. E. chappell's waggon.. Cr O'Reilly wished to bring under the notice of the Council a non-descript sledge or waggon that Mr Chappell occasionally visits the town with. It was partly on wheels and partly a sledge, at any rate it ploughed up their streets. He further understood that it was from a design by a lawyer, and made purposely to drive through an Act of Parliament. He would move, to test the question, that a summons be at once issued against Mr E. Chappell, to prevent him using his cart in the I Borough, under " The Public Works Act, 1876," clause 97, sub-sec. 6. Cr Meech had pleasure in seconding the motion, as the conveyance in question was a nuisance, and should be stopped. The motion was put and carried. gravel and foreshore. Cr Meech drew the attention of the Council to the great injury being done to the Cemetery road below Wagstaff's, by people removing gravel from the side of the road. It was being quite washed away. He would move that the Clerk be instructed to give notice to persona removing gl'avel from the foreshore of the Borough, that they will in future bo prosecuted. Seconded by Cr O'Reilly, and carried. ROAD AT WAECKERLE'S. Cr O'Reilly moved that the attention of Road Board be drawn to the bad state of the road at the entrance of the north of the town, between the bottom of German Bay hill and Waeckerle's. The motion was seconded by Cr Cullen, and the Clerk was directed to write to the Road Board on the subject. LAMP AT WAECKERLE'S. Cr Annand wished to ask if the Road Board had replied to the Council's letter re paying half of cost of erection of maintenance lamp at the north end of Lavaud street, and he also wished to know by whose authority it was erected ; he was sure there was no resolution of the Council to do so, aod he objected to keeping the lamp in question burning beyond the boundaries of the Borough. Cr Meech had little doubt but that the Road Board would be their share in a matter that benefited the public so much. It would be better to write them again on the subject, and ask if the report in the Mail of their meeting at which the subject was considered was correct. The Clerk was directed to communicate with the Board on the subject. BANK BALANCE. The Chairman reported that the debit balance at the Bank that day was £159 19s 9d. The Council then adjourned.
