AKAROA BOROUGH COUNCIL.

Special Meeting,

Tuesday, August 27. A special meeting of the Council took place on Tuesday evening last for the purpose of deciding whether Cr O'Reilly or Cr Bridge retire at the forthcoming election. Present—His Worship the Mayor. Crs Waeckerle, Annand, Sunckell. Billens, Cullen, Meech, and Penlington. The minutes of the last special meeting were read and confirmed. In reply to Cr Cullen, tho Mayor stated that Mr W agstafr's resignation had been sent in in writing in accordance with clause 4 of the Municipal Corporations Act, 137G, and was duly entered on the minutes, which were accordingly referred to. His ■'■ Worship went on to say that they were j aware of the object for which the. meeting 1 was convened, and had doubtless seen the

remarks made in the Akaroa Mail of that date. He thought the case quoted there was not exactly parallel. With regard to Mr Travers' opinion, or that of the Town Clerk, Wellington, they need not concern themselves. Clause 4 of the Municipal Corporations Act was very plain and explicit with regard to resignation ; it was as follows : —" An *' extraordinary vacancy ' means a vacancy arising from death, resignation, &c. A resignation must be in writing, signed by the person resigning, and delivered to the Mayor or Town Clerk." This clause had been observed in the case of Mr Wagstaff's resignation, which was duly accepted, and another .member had been legally elected in his place. He considered their position was not to be questioned. All. they had to do now was to carry out clause 64 of the Act, and decide the question of the retirement of either Gr O'Reilly or Cr Bridge by lot This was accordingly done, and, it having been previously agreed that the councillor whose name was drawn should retire, the lot fell on Cr Bridge, who accordingly retires, but is eligible for reelection, Cr O'Reilly remaining in office. The Council then adjourned.
