AKAROA RESIDENT MAGISTRATE'S COURT.
4> Tuesday, May 14. (Before Justin Aylmer, Esq., R.M.) Civil Cases, daly v. curtis. Mr Nalder appeared for the plaintiff. This was a judgment summons for £28 15s Bd, the total amount of the debt at this time amounting to £32 16s lid. The defendant pleaded he had been unable to pay the debt, but had made an arrangement with the plaintiff to work it out. Mr Nalder said the defendant had
shewn no intention of paying the debt, which had been outstanding for a long period. He would press for an order under " The imprisonment for debt abolition Act, 1874," Section 5, as follows: — " Subject to the provisions hereinafter mentioned an}' Court may commit to prison for a term not exceeding three months, or until payment of the sum due, any person who makes default in payment of any debt or instalment of any debt due from him in pursuance of any order or Judgment of that or any competent Court." Mr M. Daly said he was unaware of any agreement having been made with bis father, as asserted by the defendant. The Bench ordered the defendant to pay £1 per month, or in default two months' imprisonment. r. bayley v. c. duduoit. Iv this case, which had been adjourned from last Court day, the Bench gave judgment for the amount claimed with costs. The Court then adjourned.
