AKAROA RESIDENT MAGISTRATE'S COURT.

Tuesday, August 21, 1877. (Before Justin Aylmer, Esq., 8.M.) POLICE V. B. BROOKE. For having his chimney on fire. Case dismissed, as the accused had only just moved into the house. Civil Cases, jonks v. goodwin. This was a charge brought by plaintiff against defendant for allowing a ferocious dog in his following to be at large unmuzzled. Mr. Inwood appeared for the defendant. The plaintiff gave evidence that his little girl had been bitten by a dog which she had recognised as belonging to defendant - After hearing the evidence, the Bench dismissed the case, there being not sufficient proof as to the identity of the dog. ARCHER V. O'REILLY. This was a claim for £4 4s. The sum of £3 11s 6d had been lodged in Court. The plaintilfE claimed the full amount. Defendant admitted the bill, all but 12s 6d put in as a set off. The plaintiff said he claimed the amount for firewood which he had delivered. By the defendant: I rendered the bill on the 14th inst. You asked me to take the rack, and I declined. That had nothing to do with the case. You offered to pay the account less 12s 6d I refused to take it as the rack was incomplete. By the Bench : My objection to take the rack is because it is incomplete. He also holds iron work belonging to me of more value than the rack. The defendant said he had got a carpenter to make the rack for Bs, and his own work added to it made 12s 6d. This the plaintiff refused to take away. He had offered to pay the amount claimed, deducting this 12s 6d for the rack. After hearing the case the Bench gave judgment for £3 11s 6d. The rack and the ironwork to be handed to plaintiff forthwith.
