The evidenpe. chow that the been before the Court :£at; being illegally on premises at Head of '.Bay on Ist inst., was still hanging about public houses, although advised /-by th'tf Bench to go , to work. It appears that he: was found in the creek near Hahn's,on the,, evening of Thursday last, and after a great deal of trouble was got to the station. He had previously been seen wandering about in the dark and must have stumbled into the creek. The accused'admitted that he knew nothing whatever of. .how he got into the creek, or where he was coming from or going to. Fined 205., or in default 48 hours. The latter alternative was preferred. WASCOE V. HAMMOND. This was a claim to recover the sum of £2 for damage done to a boat of plaintiffs, by defendant taking it from Daly's where it was moored, on Bth April last while a S.W. gale was blowing, and not satisfied with taking it once, took it again in the evening. Mr. Higgins, ship carpenter, estimated the damage at £2. ■ D. Saulo gave evidence, and said he never-, gave the defendant permission to use "the boat, and that he took it at his own risk. The defendant did not deny using the ■boat. The Bench thought the evidence of an expert as to cost of repairs would be useful, and adjourned the case till next Tuesday, to allow the evidence of an expert to be taken.
