Foster said he did not see McDonald. Without calling oil the. evidence for the defence, the Magistrate dismissed the charge of manslaughter, deciding that it was not a prima facie case for committal. He also decided that the alternative charges of dangerous driving and driving without due care and attention and without reasonable consideration had not been proved. All the summonses were dismissed. A London cablegram dated July 22 stated: E. A. McDonald, the wellknown cricketer, was killed in a motor accident. The car he was driving collided with another vehicle near Bolton. McDonald, a fast bowler, represented Australia in Test matches against England and later played for Lancashire in county cricket.
