CLAIM FOR £25,000
ALLEGATIONS WITHDRAWN. AGREEMENT IN TWO CASES. (Special to the “ Guardian.”) GREYMOUTH, August 2. A withdrawal of the allegations of fraud against Joyce and Brosnan were made by Mr E. K. AVilson, counsel for the plaintiff, in a case in which John AVilson is claiming in the AA 7 arden’s Court at Greymouth, the sum of £25,000 from Sarah Ellen Campbell, Bridget Monica Bayne, Theresa Margaret Goldsmith, Gerald T. Joyce, Thomas Francis Brosnan, and the Golden AVcst Sluicing Company, on the grounds of alleged fraudulent conspiracy and false and fraudulent misrepresentation. Mr Wilson said he had intimated to Mr AA 7 . D. Taylor, who appeared for Joyce and Brosnan, that he was prepared to amend the statement of claim, withdrawing the charges against his client, save that in the evidence given against Joyce he procured the execution of a document not understood by AVilson. Mr Taylor, as he was perfectly entitled to, wished since the matter had been commenced the way it had, to remain in the proceedings. Therefore he would not press the application to amend the proceedings. Mr Taylor said he was wanting an unqualified' withdrawal of the allegations of fraud. Did he understand from Mr Wilson that he was now prepared to give that withdrawal? Mr A\ 7 ilson said he was prepared to give an unqualified withdrawal of the charge of deceit against Messrs Joyce and Brosnan. He did' not suggest there was anything in the nature of fraud.’
Mr Taylor said that as the suggestion was still that John Wilson did not understand the document he signed he would prefer to remain in the case.
