A MURDER TRIAL.
FOURTH JURY DISAGREES. (United Press Association —Copyright.) MELBOURNE, July 29. The jury disagreed at the fourth trial of the charge against Rupert Davies and William John Cody, of having murdered James Edward Scriven, a titles office messenger, on January 31. The prisoners were remanded for a. further trial. This is the first occasion on which a person in Victoria has been tried four times for a capital offence. If the new trial proceeds, it will be the first time in Australia that a person has been presented for a fifth trial. The recent practice has been to abandon the prosecution aftrr three aboitive trials. At the first trial the jury disagreed. At the second accused were found guilty and sentenced to death. An appeal to the Court of Criminal Appeals was dismissed, but an appeal to the'High Court was upheld. A new trial was ordered and resulted in a disagreement.
