A SERIOUS CHARGE.

TINWALD ASSAULT CASE.^r

In the Ashburton Court this morning, before Meessrs R. Galbraith and R. Clark, J.'sP., Cornelius Patrick Sullivan was charged with, assault on a married woman at Tinwald, with intent to commit rape. Accused was represented by Mr Kennedy, and Senior-Sergeant Ryan conducted the prosecution.

Dr. llondle said he had examined the victim of the alleged assault, and found her to be suffering from shock and in a state of nervous collapse. On hearing the story' of the assault, witness made an examination, and found marks which corroborated her story.

The, victim of the.alleged'assault said she was 56 years of, age. r , She was, a married' woman,, residing, with her husband ~'at ,TinwakU; She.liad known accused' ,for about t,wq years! She had seen him pass along,,the road on frequent occasions since she first k^e^ him. On the evening of TuesOjßy, September 12, at about .730, witness left her own hqme,,to visit a sick person. It took witness about 20 minutes to walk the distance.. It was a bright moonlight night, and witness was walking along the middle of the.road. When witness was passing accused's house she saw 'him'come from the door and out through"tlie, front ,gate. He was wheeling his, bicycle. After witness had gone.along. the road a little further accused,^caught up to her and said, " Good^vehing^. Mrs .- . How is tbo old man ?" .' Witness replied, " Good-evening. ' Who am I addressing ?" Accused .said, ,','Sulliran." At the same time he pushed his hat back from the front, of his head. ."Accused walked along by the side of witness, and after a.little while said: "Wait a moment; I want.to speak to you." Witness said: "No; Iwat to go home. It is time all decent people were home." Witness then gave details of the alleged assault. By -Mr Kennedy: Witness was certain shel-came out of the house she had been visiting at a quarter to 12. It would take about 10 minutes to walk from the. place she had been visiting to where Sullivan met her. The nusband of the last witness gare evidence to the. effect that when his wife arrived home on the night of September 12 she complained of having been assaulted by Sullivan. She aW : peaked to have been severely handled/. . Senior-Sergeant Ryan deposed to having arrested Sullivan. In reply to the charge, accused said he had been to a social evening on the night in question, and had arrived home between a quarter-past and half-past 12. Ho (accused) said he did not leave the house again that night. Witness examined the locality where the alleged assault took place, and, roughly, it was about 10 chains from accused's House. The ground was hard and dry, and consequently there were no marks showing where the struggle had taken place. He examined.accused's- hands at the police station > .and found afresh scratch on one hand. Accused said . the .scratch was caused by tipping a - dray; This closed' the . evidence for the prosecution. Accused pleaded not guilty and reserved his defence, and was committed j for trial at the next sitting of the Supreme Court ■ at Christohurch on October. 30.
