Motion for order compalHng payment by R. McOonneil of proceeds of b-ll oi sale, Oeborne to MoOonnell.

Mr Caygill for the Peputy-Offioial Aeeignee; Mr McOonnell did not appear nor was be represented.

In this case the Aedgn.ee made applfoation to the Court to make an order compelling McCouuell to pay over the proceeds under a bill of sale, given by tbe bankrupt to McConneU, but which the Court h»d ruled wa« void ai against the Assignee.

Subsequently Mr Parnell appeared and Bald that ho had received a telegram aaking him to apply for an adjournment as Mr McDonnell was ill.

His Honor eaid that ha was not prepared to grant the ad j jam ua ant on the mere atatemont oontaiae.l ia a telegram. There was a proper course to be followed which had not been observed, but it was open to Mr MoOonnell to apply for a re-hearlng by proceeding m tbe usual way.
