CANTERBORY DIVORCE CASE

Henry Sadler Boby petitioned the Divorce Court on May 20 for a declaration of the nullity of his marriage with Mary Ann Boby, otherwise Waraes, on tne ground that when she weut through the. ceremony of marriage with him she was the wife of Robert Waraes. The circumstances of tho case were peoullar. Tho petitioner, a stockbroker's clerk, living m London, had known the respondent under another Dame proivous to 1884. After he made hor acquaiutcnance t>ho went out to New Z island, but she returned to this country m 1884, aod he and she were married m the Kegietrar's offioe at Edmonton on Angust 6 iv that year, he supposing her to be a single woman. They lived together until February m the present year, when he was served with a oitatlon at the suit of Robert Warnea, who made hlno corespondent m a divorce action, the respondent beingthe woman with whom he he h»d gonp through the ceremony of marriage On receipt of the citation he made Inquiries, and 'found that on February 2fj, 1884, or less than six months before she married him, the woman was married to Robert Waraes iv the district of Ohrlstohuroh, New Zealand. Iv March of the present year Mr B,by, Mr Warnes, and a solicitor had an interview with her at Ostend, and she did not deny either of tho marriages. It was shown In evidence tbat qs " Magdalene Smith " sho was married to Mr Warnes, and that her marriage with him wae a valid one under an Act passed by the Legislature of New Zealand iv 1880. Mr Warnes, In his evidence, stated that hid wife left him shortly after their marriage j that he came 'o this country to look for her ; and that, finding she was living with Mr 'Boby, he instituted a dlvoroe suit, making Mr Boby 00-respoadent, Mr Boby, ln his evidence, mentioned that, though Mr Warnes' aotion was lcstituted before the nullity cult, the latter had somehow or other obtained precedence m the oiase list.
