DISTRICT JUDGE RAWSON

New Plymouth, Mar oh 13. The sitting of the Commission was resumed this morning. Herman Wallath, examined by Mr jellicoe, said he had given to Mr MoLaoblsn all the papere eonneoted with the Convent building dispute, who took them to Mr Hatohison, soUottor, Wanganul. Mr MoLiohlan did his writing for him. Wallath m his evidence gave a statement of what passed between him and the Deputy Official Assignee In Bankruptcy at the time he filed his schedule. Sir Robert Stoat said this was Irrelevant to the charge against Mr Rawson, and the witness was only being made nse of to si In? mud at a respectable gentleman. The Commissioners agreed with Sir Robert Stout and stopped the examtnatloa Wallath then was orosseiamlned by Sir Robert Stout and admitted that when he oime from WaDganol with £300 he got from Hirohlson he lest £100 of it. He said he met MoLaohlan add had some drink. He afterwards went to William Humphries' shop, who agreed to aot as agent to compound with witness' creditors. Witness afterwards went to hit workshop, when he found the bundles of notes were short. Witness did not go to the polloa over the loss of the notes. He told McLauohlan who shrugged bis shoulders *nd said acotdents "oannot be helped." He did not know If he said to anyone that he .had been robbed. The witness admitted that the affidavit referred to In the ofaarge was written m his presence and from answers given by him to questions asked by Mr Samuel m the presenoe of Judge Rawson and Mr Oorkill. He signed all the affidavits lodged m Oourt. If witness* evidence did not agree with his affidavits now In court, he would leave It to the judges. He told Mr Samuel at the time that he knew English very well. The chief men who advised him before he filed his bankruptcy were Bellrlnger, William Humphries, MoLauoblan and William Bayley. The Oourt adjourned till two o'olook. The hearing of Humphries' charges waa then oontlnned. William Humphries' evidenoe related chiefly to Wallath's loss of £100. He said he believed Wallath'a loss was a fiotltlons one. Lattr. Humphries said that Wallath's loss of a. £100 was trae and not a fiotltloas one. Witness's charges, against R&wson wetein connection, with Wallath's affidavit, It was not his really, he had signed it late at night as a proper witness was not there. He had been sued for a gambling debt. He never paid that debt. No tnrther evidenoe being produoed that Rawson had ever attempted to Induce Wallath to swear what wan false In the affidavit Sir Hi Stont said never was there a more complete collapse of a charge la the history of a Commission^ Sir R. Stout oiled evidenoe to rebut all that had had been said respaotlng Messrs Samuel and Rawson trying to get Mr Hntoh'sjon struok off the rolls. Mr Samuel m his examination showed that all the aotlon that bad been taken In the matter was at the request of a client to get Hutohison's bill of costs taxed In the oase Wallath wmw the Convent authorities. When preparing the affidavit Mr Baweqn only toted In his oapaolty as Magistrate before whom Wallath tool; the oath. The question of bankrupt's expenses arose, when Mr Rawson was referred to for his opinion of the meaning of the olauee of the Bank* ruptoy Aot, and replied that he considered the Aot provided lor the payment of a bankrupt if his time , was gluen m the Interest of the estate, and he presumed Wallath would be paid for his time,* The Oourt adjourned till 9 o'olook.
