The Magistrate, however, deoided In a case where the weight of evldenoe was In favor of the contention that the trout were gaffad In the ocean near the mouth of the "Whltikl River, that the Act wai Inoperative, Inaemnoh a« when the fish left the river they were outside the soope of the Aot nude for their protection, and that no penalty oould be Imposed for taking trout ontaide the rtver. The, fiah go down to the sea, and In returning keep close In to the shore, and are easily made the prey of persons with gaffa.
