O'Donnell v Thos.Dwyer, judgment summons £'il 18s 8i. — Mr Oaygill for jadgment creditor. — This case arose out of an action heard In the Oonrt some time ago m which the ownership of a half shire In tua racing mare, Olive, was involved. O'Donnell got judgment, and the mare was selzid by the bailiff of the Oourt who disposed at »ootion of Dwyer'a half Interest for £3 10b. Dwyer complained of the amount realised being no low, but the bailiff m hla evidence stated that the mare was not worth more than £7 or £8. When Dwyer's Interest m Jtho mare was sold at auction the bailiff bought it for O'Donnell, acting on a telegram received from the Utter, Be had subsequently bought the mare from O'Donnell. — The Magistrate, while certain ( tbe ball iff 'a action bad been perfectly straightforward, thought that perhaps it was injudioious for an oflioer of the Court to aot for any person, m connection with an auction suoh as that In question ; beoauoe it left a wide door open for charges to be made against the integrity of the Oourt officials. — It was shown that since judgment was ! given m the former case Dwyer had received £40 under a bill of Bale. This money he had devoted to satisfy other debts, but made no attempt to pay O'Donnell. He pleaded that he could not pay the judgment debt, but made no application for time to be given him.— Order made for immediate payment, m default one month's imprisonment. A HORSE CASE. Edward Shaw was charged with leaving a horse unattended, A fine of la without costs was lnflloted, Tbe Court then adjourned.
