At the Supreme Court to-day, before Justice Richmond, Mr Jellicoe applied for A writ of habeas corpus to prevent the extraditionof the escapee Gasparlni. He contended there was nothing on the fane of the warrant to show jurisdiction, and it did sot appear on the warrant tbat tbe prisoner was the fugitive prisoner, and there was moeover nothing on the warrant whioh gave the Governor jurisdiction. It must be shown the prisoner was a oonviot undergoing sentence. Bis Honor said there was nothing in tbat excuse, because the statutory bad bee_ from pursued as far as applicable. Mr Jellicoe said scch coses were very rare There were no eases reported in the books, and In the absence 'of authority the warrant should conform with common law as well as statutory ; again, under the treaty extradition, the treaty requisition must come from the Governor or chief authority of the colony, from which it was alleged he escaped. This was not so, as it was signed by the French Consul of New Zealand, The case is proceeding.
