AS SBURTON— THURSDAY, (Before Captain Wray, R.M.) The following cases were deolded after we went to press yesterday. CIVIL GAHKS. Green and Scrint v J. Moorhead claim £19, Mr Purnell (for Mr Criap) for plaintiff, Mr Wilding for defendant. In thla case the plaintiffs are faimera at Mayfield, and the defendant a threshing machine proprietor, the olaloa being for damages sustained through the Alleged action of defendant m failing to perform a ooatvact ho bad entered into with plaintiff to thresh certain grain. It appeared defendant while threshing at a neighbor's place agreed to next go to plaintiff'a farm, bat a big -job offering Itself m anothor part of the district, he did not return. The plaintiffs raised no objection to defendant going away and the Magistrate said it appeared from the evidence that they had acquiesced uttha time being. P.ain tiff* were nonsuited. W. B. Compton v N. Eden claim £1 16a. Mr Outhbertuon for plaintiff. The plaintiff, who Is the Bjrough poundkeeper, some time ago impounded a horae belonging to defendant and notified the latter accordingly. Defendant did not release the animal, which was put np to auction and elicited a bid of £2. The pound expensei, however, amounted to £3 16s, and defendant waa now sued for the balanoe, £l lll6 1. — Defendant said that he had given the horse away, but he did not know if the parson to whom he had given it ever took delivery, — The Magistrate disallowed an Item m the olaim, 1« per day for poundage fee, eayiog that such charge should only re made for the first day the animal waa m the pound. He gave judgment for plaintiff fur the balance 15s. The Court then rose.
