Judge, 1b steward of the coursing meeting lately held at PhunpTpn Park, called the Waterloo meeting ; that plaintiffs nominated a dog called John Drumm for the said Waterloo Gap, aud paid the nomination fee of £12 10s to defendants, who accepted the same Id the fourth roand of tho said Cup, John Dramm met and competed with a dog oilled Haroun-al-Rasohld, winning the course ; notwithstanding that John Drumm won his course with Haroun-al-Rasohld and was entitled to continue m the Waterloo Gup, the Btewardß, nevetheleas, deolined to allow him to continue iv the same ; Haroun-al Raechid, subsequently to beingidefeated by John Dramm ran a natural bye, then met and defeated Killarnoy m the final coura?, and the stewards adjidged him the winner of the Gap, bat the plaintiff* say that John j Drumm is the winner of the said cup, and claim the stakes. The value of the stakes payable to the winner of the Waterloo Cup is £113 Is. Plaintlffj abandon £13 Is so as. to bring the ease within the jurisdiction of the court. The evidence showed that when Haroan and John Drumm were slipped they changed places before the judge caught sight of them. Haroun won, and the judge ordered the flig steward to pat up the red flig, being under the impression that the dog w&s running under that oolor He discovered his error on referring to the slip steward, and ordered f^e white flig to be hoiated aDd gave the course (o Haroan. The bench gave judgment for the defendants, but refased to allow costs on account of the remisneßg of the fl»g steward.
