In Hills r. Mills and Ferrier, evidence taken on commission in Melbourne was banded to the Jn J ge but not read. Acts of criminality were proved to have been committed at Wangareta, Melbourne, and Williams!own. The parties went home by an Orient steamer under au assumed name. A detective went ou board the same vessel and served them with a citation as they landed in London. Mr Denniaton, who appeared for the petitioner, contended a* there was nothing to show collusion there was no reason in the absence of statutory provision to the contrary why the decree should not be granted. In the absence of the petitioner, the Coart took time to consider whe her the petitioner’s attendance could be ditpenibd with.
