Plaintiff contended that defendant had raised his dam so as to back the water on their wheel and diminish its power lessen prodnotion and deterioratethe value of the flax. Defendant pleaded that the backing op of the water was caused by the creek being obstructed by the refuse from plaintiff’s mill.’ Mr Travers, for plaintiff, gave notice to move at Wellington for a new trial.
