THE TOTALISATOR CASE.

In the Appeal Court, in the totalisator case of Franck v. Stead and others, judgment was given for the defendant, with costs. The Court held that the machine of the defendant, while similar to the plaintiff’s in some respects, was not an infringement of his patent. Application was made for leave to appeal to the Privy Council. The Court, however, was of opinion they had no power either to grant or refuse leave.
