RESIDENT MAGISTRATE’S COURT.
* ASHBURTON. —To-Day. (Before Mr J. N. Wood. R.M.) CIVIL CASKS. Clarke v. Firth. Claim LI 6s Id. Order for amount with costs. Martin v. Meharry. Mr Branson, for the plaintiff, said that the matter had been settled out of Court without his bein<j consulted. He applied for the case to b e heard. Solicitors had a right to be protected by the Court. The Magistrate saiil ho had no power to hear the case in th e absence of both plaintiff and defendant. Cas.e struck out.
Dunstan v. Muir. No appearance. Case struck out.
Spence v. Brydone. No appearance, Case struck out.
Jones v. Kelly. Claim for rent, L 9 10s. Mr O’Reilly for defendant. A witness named Samuel Guinney was called, but did not appear. Mr O’Reilly produced receipts paid subsequently to the last date mentioned in the claim. The claim for the first part of the rent was on Guinney, who took the place, not on Kelly. The Police Magistrate said that the plaintiff should not have let Guinney leave the house without making him pay. Guinney was apparently the right man to sue. Plaintiff was nonsuited, with LI Is costs. Reid and Gray v. Harvey. Claim, LI 7 13s on a promissory note. Mr Crisp foi ■ defendant. The manager for Reid and; Gray deposed as to the claim. By Mr Crisp: George Harvey’s signature is that, attached to the promissory note. I die I not see him write it. I senfhim notice of dishonor as soon as I got i c from Dunedin.. He gave the promissory note to me. Ik was for a plough. There was no promise to renew the note if required. Mr Crisp said that as the defendant had not thought fit to appear, and had tried to settle the matter behind his back, he could not say anything more. Order for amount, with costs 19s.
Spence v. Brydone. Claim for LI 16s. Order for amount, with LI 10s costs. Orr and Co. v. Pearce. Claim for LIOO. Mr Crisp, fir defendant, contended that under the 20th clause of the Act, the summons was not served within sufficient time. The Bencli concurred. Plaintiff was nonsuited without costs. The Court then adjourned.
