A special case. Memo. I am willing to waive the right of Pre-emption over the tract of land known by the name of Waimai and the Tumu - near Mahurangi - on the terms specified in the Gazette. The above tract may be considered fifty acres - more or less - at all events I will consider it to be no more - untillit shall have been surveyed hereafter. The fees to be paid now would therefore amount only to ten pounds - whatever may be the extent of the tract. Robt. FitzRoy, April 22, 1844. Supposing the tract of land to contain more than fifty acres - the additional fees may be paid after a survey has been made - some time hence. R. F.
