An important nautical case, and one full of interest for mariners, was heard in the District Court, Melbourne in the early part of this month, when a seaman named William Bienell claimrd from Capvain Heath, of the British ship Bothwell Castle, the auui of £50, wages due Bignell shipped in the Bothwell Cafiilf!, in the United Kingdom, on the Ist of April, 1878, for a. period not ex ceeding 'three years at £4 10s per month, and cr\utjnvierl in the ship uutil she arrived at Port L"-nia, Mauritius, at the end of October, 1879, when there was due to him £61 108, he having received an account since his shipment of £24. At Port Louis he went ashore, pot. iolo trouble, and was ordered to pay a fim of 3r, but not having the money upon him he was imprisoned in de fault. While he was in gaol, Capfain Heath sailed, not knowing 1 , according to his evidence in Court, that Bignell was not on l)Oard ship, Bigoell having gone ashore, be maintained, without his knowledge or consent. After leaving Port Louie, he entered Bignell in his log book as a "des«rtftr. >} and endeavored to justify that action in Court on the grounds (hat it was against his order that BigDell went aßbore when he got into gaol, and that he was not aware that Bignell was $n gaol. But several of the claimant's shipmates gave evidence to the effect that they had been in. the habit of going ashore when they pleased without leave whilst the Bothwell Castle was in dock, nnd the claimant stated that he bad, while in gaol, eent a message to Captain Heath telling him of his position and asking bim to pay the fine. Bignell claimed £50 of the £61 10s due, foregoing the £11 10s to bring the ca»e under the jurisdiction of the Court. The Bench gave judgment for the amount claimed with £5 5s costs.
