[Before A. Le Grand Campbell, Egg R M and G. J. Sparrow, Esq., J.P.] ' December 18. Secretary of the Takaka Road Board v H Pollard, under the Dog Nuisance Act, for having a. dog in his possession last June without destroying it. Defendant contended that he was not the owner of the sinful pup he having given it away to John M'Lean in the month of May. John M'Lean swo-e that defendant gave him the pup in question in the month of May. Judgment against the defendant, who was fined 5s and costs, which he paid under protest, John Moulder was charged with an attempt to commit an indecent assault on the wife of Henry Stanton, a native. There was no evidence to support this serious charge, and considerable sympathy was expressed with the accused, who is known to be a very sober and industrious young man. After a very careful inquiry, the case was dismissed with costs, Stanton stating that in future should any white man interfere with his wife he would kill him. lleilly v. Gray.— Plaintiff claimed £3 133 for goods delivered. (Defendant did not appear. Judgment for plaintiff with costs. 11. Moore v. Rawiri, a native.— Piaintiff claimed £10 or the delivery of a young horse with his brand, alleged to be illegally in the possession of the defendant. Mr Cann conducted the case for the plaintiff, and Mr P Dougherty was sworn in as interpreter. This was a case of disputed ownership, each party contending that the horse belonged to him. Considerable interest was taken in the case' and about six witnesses were examined for the plaintiff, and their evidence proved that he waa the owner of the horse in dispute In the course of the evidence it was proved that a foal about the same color and age as the one in question waa found dead some time since, and defendant contended that the dead foal belonged to the plaintiff. Judgment was reserved until the following day, when it was given for the plaintiff with costs, defendant either to pay £10, or give up the foal. Defendant refused to give up the foal, and took it home with him. He also refuses to pay the £10 or costs.
