WARDEN'S COURT.

Friday, April 16. [Before J. Giles, Esq., Warden.] SUITS. R. J. Seddon sued Charles Schaivi for not having fenced nor used Lis residence area No. 294-G3, situate at Fifth street, for the purpose for which it was granted ; and prayed that a forfeiture of the area be decreed, and the certificate thereof cancelled. The evidence of the complainant and several witnesses went to prove that the complainant, who holds land adjoining, suffered considerable annoyance throng!) the area in question not having been sufficiently fenced.—The Warden gave judgment as follows : Forfeiture decreed on the ground that the area has not been placed according to regulations; bnt defendant permitted to redeem the forfeiture by paying costs of complainant, amounting to £3 12s. Mr Jones appeared for defendant. Henry Richards and Robert Wagshall v. Alexander Reid and others.— This was a suit praying to be put in possession of a special site No. 29937, situate at Larrikins on the ground that the site was abandoned.-—Judgment postponed pending survey. The same complainants also sued the same defendant for surplus ground alleged to be contained in double area claim No. 29911.—Judgment in this case was also postponed for service of summons on the legal representative of John L. Gaii'd, deceased.— Mr L>. Hannan appeared fur complainants; Mr Seddon for defendants.

Thomas Roth well and others sued Stephen M'Neill for noc having fenced nor occupied his residence area No. 12076, situated between Diiiman's Town and Larrikins, and praying that the- certificate thereof be cancelled. , The defendant in this case objected to the complainants electing a flume outside his fence on land which he claimed as a portion of his registered area.— The Wiude.n, lit. the, request of the complainants, visited the ground, and after returning to the Court recorded the following judgment as by arrangement between the p.-rties:—Defendant to take a stuiighr line 'from stumps near his gate iu3lde. to tut iovvoi' comer of

his fence on Hack ni-nr flu'r.ing vccnily erected by complainants, and to give up all outside that lino; each party to pay their own costs. —Mr Seddon appeared for complainants; Mr Jones for defendants. APPLICATIONS. William Kilieen was "ranted a resid euce area of live-eiuhtlis of an acre, being sections 2G7, 2GS, 2G9, 270, First street, and section 52, Main street, Kumara. William Morris's application for four months' protection for ex;ended claim So. 370SG, LarrikiiiS, on the ground that applicants will tie engaged in driving a tunuel to No. 2 chaunel, was granted. Augusius Se'.l-'rs' application for a losidi'iice area of balf-an-acie fronting the east boundary track, Patrick's Terrace, was granted. James Holmes, by his agent Mr Seddon, was granted an extension of his bianch race No. 4:6279, from Patrick's Terrace. Edward Bremian's application for an extended claim of one acre at Upper Larrikins, was postponed for advertisement.—Mr D. Haunan appealed for applicant. Matthew Davidson, by his agent Mr Seddon, made application for sis months' protection for a fifth share in doublearea claim No. 36083, for the reason that the claim could not be profitably worked with the full number of men-. Protection granted for three months. R. J. oeddon's application for a residence area, near Fifth street, was postponed for advertisement. This concluded the business of the Court.
