, : Friday, July 4. . (Before Mr Warden Whitefoord,/ Ollivier and party (Eclipse Company) v. jWm. M'Grath.T— A : complaint that the Seferidant was illegally interfering with the company's leasehold by running tailings, Jntp, r the,,bed of Half-Ounce Creek, near the company's reservoir. The case for the company was surrounded with a complete fog as it was stated in Court. The defendant is slucing on a terrace over the bed of the creek, and he stated that he must of necessity, run his tailings Into ' ;the creek or discontinue working. The iWarden adjourned the case until he . visited the ground and made a personal examination.^ , „ „- -.- . ■'<''■ Cunninglfem y[ M'Grath.-f-A complaint against/th^l same defendant that he was running tailings' in! ihe slaughter-yard of the plaintiff. The plaintiff could not produce a perfect title to hold the ground on which the slaughter-yard -was built, and 1 the defendant said the yard was erected upon a registered tailings site. The Warden thought the ' plaintiff had no redress, but he would visit the scene of the v{ the dispute and endeavor to make an equitable arrangement. ■ Francis Hallinan applied for a certificate of registration for, a head-race at Brandy A Jack'svCreek. Patrick^ O'Connor and party opposed on the ground of interference with their registered rights., The applicants wanted ( fcb, raise* the tail-' water of the objectors before they were finished using it.
