Friday, November I . (Before Mr Warden Whitefoord.) Sinclair andPhilpoiMy. ArthurO'Keefe. — A claim of L6O, as damages for injury done to two water reservoirs of the complainants at Nelson Greek, by running tailings and sludge into them. The causes of action arose at different times. The case of the complainants, as far as" they had it prepared, .was taken, and the defendant was granted an adjournment to procure witnesses for the defence. The adjournment wasgranted because of insufficient notipe to the defendant of the intention to bring the action on the part of the complainants. The complainants would be allowed to produce supplementary evidence. Costs to abide the result of the action. The decision in this case will materially affect the relations between terrace and creek sluicers, and after the final hearing a full report will be given. Arthur O'Keefe applied for a certificate of registration for a tail-race at Nelson Creek. The application was opposed by P. Lawler, and also by Sinclair and Phi}potts. The application was postponed, pending the cleoision in the previous oase. The following applications were granted: —Lawrence and Clancy, for a frontage tunnelling certificate at the junction of i Half- Ounce and Duffer Creek.— John Abbott, for a dam at the first right fork, Duffer Creek.— M'Quillan and Campbell' for a right to erect 3Qoft Burning on the terrace above Martin's Creek, Little Grey district. Opposed by Cantrell and party, on the ground of interference with their registered rights. .Granted, after a long hearing, subject to non-interference with Oantrell's workings.— Abbott and ßaybut, tor an extended area of ground of 170x85ft, at Duffer Creek.
