Court of Appeal. A FEILDING CASE.
I Per Pres~ Association] Wellington, Dec. 2. Mf Justice Edwards han heard argument in the case of Flnvall and the Colonists' Land and Lonn Company, which was an appeal from the decision of Mr Stanford, ft.Cv],, at Feilding, by which he diuaiissed an information for a breach of the building bye law, which charged defendant with erecting a building in the town without, having a brick wall between it »nd the next house. The Magistrate dismissed the information on the ground that the Feilding Borough Council had npproved of tbe plans before the building was erect* d, and could not now object. The principal ground of the appeal waa thai, the bye-l-iw, beine for the protection of the public could not be dispensed with by tho Council. Af er hearing argument, His Honor eaid as the question was an important one he would reserve his judgment.
