(Per Press Association) Auckland, This Day. Judge Connolly yesterday upheld the decision of the Commissioner of Stamps assessing stamp duty J512.725 on the estate of Jan. Delworth. The trustees had objected to the assessment on the ground that a part of the estate was set apart for the establishment of the Del* ; worth |Ulstor Institute which, as a benevolent institution, was exempted from stamp duty under the Charitable Gifts Duties; Exemption Act, 1888. His Honor decided that the proposed institution, in view of its.object to train children in the tenets of the Church of England so fihat they should belong to that Church, and its being directly under the control of the Church of England, was not exempt. The appellants save notice of appeal.
