Feilding S.M. Court.
(Before Mr Stanford, S.M.) This Day. Peter Scheldt v. 11. C. Smith ; claim £2 0s yd Mr Sandilands for plaintiff. Judgment for plaintiff, with costs 9s and solicitor's fee ;*ss L. E. linado v. F. Chuvcher ; claim Xl Is. Mr Rsade appeared for himself. Judgment for amount claimed, with costs 11s Manchester Road Board v. F. Maul ; .-'.aim -I' 45s 4d for rates. Mr C. Bruy, clerk to the 11 o nil Hoard, appeared for the plaintiff body Judgment for plaintiff for amount cl-iimcd, with costs Bs. Manchester Road Board v. C. Wildbore ; claim .i'o for rates. Judgment for amount claimed, with costs 7s. J. 11. Blackiuore, poandkeepec of Feilding Borough, charged Samuel Wilson with grazing five horses in Warwick street on March Tiih k?t. Defendant pleaded " Not Guilty." Mr Prior appeared for plaintiff, and Mr Sandilands I for defendant. J. 11. Blackiuore gave evidence of the offence. Edward Mines and Thomas Smith gave evidence for the plaintiff. S. "Wilson deposed that the boy was instructed to drive the horses, leading or riding one ; he denied the charge of allowing tho horses to graze on the roadside. John Death deposed to driving to the paddock on tho day in question ; he was not allosving the horses to graze by the road- side ; ho led one ot the horses. A Wilson gave corroborative evidence to previous witnesses. His "Worship considered the offence was proved, and according to the boy's own evidence he was over an hour on the road. Defendant would be fined £2, with witnesses' expenses 10s. I Thomas Foster, assistant ranger for the Feilding Borough, charged F. W. Legg with unlawfully rescuing cattle, seized for the purpose of being impounded, on March 20th. Mr Prior appeared for plaintiff and Mr Heade for defendant. J. T. Foster, deposed that on March 20th he seized six cows, which were grazing in the street, for the purpose of impounding them ; defendant came out from his property, and witness offered to give them up for Is, which was the driving fee ; defendant did not offer witness a shilling ; defendant and his wife rescued the cows. Henry Peach deposed to seeing defendant rescuing cows from Foster. The defence was that the cows were illegally seized and that the defendant wanted to go into his house to get a shilling, but plaintiff would not wait. F. W. Legg deposed that he had charge of tho cattle the whole time ; he was asked for a shilling, but demurred at first and witness eventually agreed sooner than have his cows worried ; Foster wouldn't wait until witness went into his house for the money ; he admitted rescuing the cows. Mrs Legg and Mrs Lyne gave evidence in corroboration of the previous witness. His Worship considered the case proved and would impose a penalty of 20a, with witnesses expenses 21s, costs of court 9s, and solicitor's fee 21s. L. E. Reade v. F. Wellsman ; a judgment summons claim L 2. Defendant was put in the witness box, and examined by Mr Reade as to his ability to pay. Judgment was given that the amount be paid forthwith or in default one month's imprisonment in Wanganui gaol. The case, G. Worsfold v. H. J. Hayns, a claim for «tl9 10s, for damage sustained by plaintiff owing to his horse being killed through the alleged careless driving by defendant without lights ou a dark night, was proceeding as wo went to press.
