Police Court
THIS DAY. (Before Messrs Carthew and Kirton, J.P.s) James Hovind was charged by the ranger, J. T. Foster, with having rescued a horse on April 13th. Mr Richmond appeared for complainant. Accused was fined Is, with costs 7s, and solicitor's fee 10s 6d. The Bench, in giving judgment, said there seemed to be au idea that cattle could be run on the roads through the night without beiiig iinpouuded, but tho Act clearly said that j cattle could not run nigbt or day on the i roads. T. Dixon v, Wm. Whisker. Mr Sandilauds for complainant, and Mr Bishop for defendant. This was & case in which plaintiff sought to get an order for tho removal of the defendant from Dixon'B property, where Whisker was alleged to be trespassing. T. Dixon deposed to making arrangements with Whisker by which the latter was to be allowed to cut firewood, in consideration for which defendant was to put the rubbish in heaps ; repeatedly told defendant not to cut totara and to leave the ground, but lie would not do so. Iv cross-examination witness said he considered the wood and blocks still left on the ground belonged to him. L. A. Caldwell understood that Whisker was to be allowed to clear abont six or seven acres for Dixou, and receivo all the firewood in consideration. Harry Holuian and George Dixou also gave evidence. Win. Whisker, defendaut, deposed tbat no mention was wade that be was not to cut totara; had a contract to complete the whole of the burn. In cross-examination he said there was no time limit, and he only cut branches of totara into blocks. F. Thompson gave evidence for the defence. Mr Bishop having addressed the Court for the defence, Mr Sandilands replied. Defendant was found guilty of ! trespass since April Ist last, and was fined Is, and costs 28s.
