WHANGAREI, Sept. 11. Mr. Ca-rrol Harley, S.M., at tlie Kaikohe Court yesterday, seiit Thornaa Bireli Smith to gaol for two mouths 011 a charge of cruelty to his 14-year-old. son whom he tied naked to . a large tree and gave 38 strokes with a supplejaek. It was stated in evidence that the bov has been an incorrigible delinquent with a big list of thefts including brealcing and entering the Bank ofNew Zealand 's brancli at Papakura. He had, according to his father, openly defied* the police, Magistrates, child welfare officers and his parents. He had absconded from the Mt. Albert Boys' Home and was onee held for the weekeud in Mt. Eden gaol while awaitiug charges at the Auckland Children 's Court. When _ interviewed by the police, accused said: "Joseph would uot stop^ stealing. This is the Maori way to stop it." The Magistrate, in sentenciug Smith, said: " While this Bench coucedes that a father is entitled to punish his child when all other means have failed, we do not consider that this was a reasonable thrashing. ' '
