Man Fined For Building On To Garage
Prosecuted under the Building Emergency Regulations of 1940, C. Wallace of Levin, was fined £7 10s ■in respect of the erection of a shed on a property in Hannan Street. Mr. G. McGregor of Palmerston North who appeared for the Crown, said defendant had applied for a building permit for a shed 10 ft. x 18 ft. He wa's told this could not be grante-d but he would be peririitted to efect dhe 10 ft. x 8 ft. Defendant had thereupon laid the foundations for the full s;zed shed, but had bpilt a shed 10 ft. x 8 ft. in keeping with his permit. Later hb had. added to it with second hand timber. Thefe was a lot of this sort of thing going on, continued Mr. McGregbr, and the department must have full compliance with the regulations, dnd conditions of permits. The penalty provided for the breach was a maxiirium of £200. Appearing for -defendant, Mr. N. M. Thomson of Levin, said his client pleaded guilty and would take the ehargfe as re.ad. His client had been led to believe when he, applied for a permit that! he could not My.e the full size unless the additionai area was of second hand timber. There had been no additionai concrete used. He, should, however, have re-. applied for a -permit. fbr the addition -said Mr. Thomson, even if it was to be of second hand timber. Mr. McGregor said that there appeared to be a dispute in the facts. As far as the department v^as concerned, there had been nothing said about the use of secbnd hand timber. The .concrete had been ppt dbwn for.the.whole of the atea. Calied by Mr. McGregor, Mr. D. Harvey, building ihspector of Palmerston North, said that he had inspected the garage and found it tp have a ebiriple.te concrete floor. There had been 200 siiper feet of hew tihibe'r used and half a tbh of cemCnt. He had rio knowledge of perihigsioh grarited to dse the secpnd hand timber.
